The Weights and Measures Services Division (WMSD) is provided the authority under Arizona Revised Statutes (A.R.S.) Title 3, Chapter 19 to conduct regular inspections of weighing and measuring devices used commercially within Arizona. In addition, WMSD has the authority to conduct other inspections to ensure compliance with fuel quality, gasoline vapor recovery, packaging, price posting, and price accuracy requirements. Inspections are generally unannounced to the public and/or regulated party in an effort to obtain a true representation of commercial device maintenance and use, as well as day-to-day business practices. In nearly every instance, WMSD investigators serve as a third party to help maintain fairness and equity in the Arizona marketplace. Investigators are trained to enforce requirements set in Arizona statute and rule, and technical handbooks published by the National Institute of Standards and Technology (NIST). If violations of these requirements are found during an inspection, WMSD investigators have the authority to issue enforcement action, which may include: written warnings, tagging a device out of commercial service, "Stop-Sale, Stop-Use" orders, and/or confiscation of a non-compliant commercial device. For violations that are directly detrimental to the consumer and/or harmful to air quality or the environment, civil penalties may also be issued. Enforcement actions generally remain in effect until the violation is corrected by the licensee and/or Registered Service Agency.
